Where the data sits, in law.
A data centre in Europe is not the answer. What counts is which law applies, and who can compel your supplier to hand the data over.

Who can switch what off.
If your model supplier withdraws access tomorrow morning, what stops working? A weights file already inside your perimeter has no remote switch.

What it costs to change.
The question to ask before signing is not how good the model is, but what it costs to replace it. Sovereignty is not buying European: it is being able to change without rebuilding.

Who is accountable, and on what terms.
Use limits listed one by one, logs kept and reachable, no unilateral change to the terms. Clauses become verifiable only when the infrastructure is under the buyer’s control.
This is not self-sufficiency. Giving up the best models in the world on principle is a tariff your competitors will not pay. Open models in-house where the data cannot leave, frontier models over an API with enterprise guarantees where you need maximum capability — behind an architecture that keeps them replaceable.
