Euro 5 diesel pushed to 2027: what moved, and what did not
7 min read
The replacement plan you built around a date — the vans to scrap by September, the lease to renegotiate, the two lorries kept alive one more winter — rests since this morning on a different date: it moved by twelve months, three days before it was due to bite. If you conclude that your Euro 5 diesels have a guaranteed winter in the Po valley, you have read the wrong sentence. The one that stops your vehicles was not touched.
One decree, one article, three days
Decree-law 167 of 28 September 2026, in Gazzetta Ufficiale no. 225 of that day, has been in force since the 29th. It has two articles: the second sets the entry into force, the first — «Misure urgenti per la continuità della circolazione nel settore dei trasporti», urgent measures for continuity of transport — does one thing. In article 1, paragraph 2, fourth sentence of decree-law 121 of 12 September 2023, converted with amendments by law 155 of 6 November 2023, it replaces «a decorrere dal 1° ottobre 2026» with «a decorrere dal 1° ottobre 2027». Nothing else.
The preamble says why: the extraordinary need and urgency to avoid, from 1 October 2026, significant repercussions on citizens’ mobility, on the continuity of transport services and on the economic and productive system of the areas concerned. Approved in the Council of Ministers on the 24th, signed on the 28th, effective from the 29th: three days of margin on the deadline it postpones.
The paragraph has six sentences, and one was touched
Everything is here. Article 1, paragraph 2 of decree-law 121/2023 contains no ban: it contains six sentences with different effects, and the postponement touches only the fourth.
The first sentence confers a power. Pending the update of the plans, the regions may impose a structural restriction on road traffic between 1 October each year and 31 March of the following year on cars and on N1, N2 and N3 commercial vehicles running Euro 5 diesel, «esclusivamente a far data dal 1° ottobre 2024». That power has been open for two years, and yesterday’s decree does not go near it.
The fourth sentence — the only one amended — turns that power into a planning duty: from a given date the restriction is written into the air quality plans of the regions referred to in paragraph 1, which adopt the implementing measures. The date was 1 October 2026; it is now 2027.
The sixth sentence closes it: «Resta ferma la facoltà per le regioni di introdurre la limitazione strutturale alla circolazione […] prima del termine di cui al quarto periodo» — the regions keep the power to introduce the structural restriction before the fourth sentence’s deadline, by updating their air quality plans and amending the implementing measures. This is not a grey area: the region that moves early is expressly authorised.
Put plainly for anyone with vehicles on the road: what has been postponed is the duty to write the restriction into the plans, not the power to impose it. Anyone who read “Euro 5 ban postponed” and deferred replacements bought twelve months from the national calendar, not from the region their vans enter every morning.
The escape hatch points the other way
The fifth sentence — invoked at the opening of the fourth by the clause «Fatto salvo quanto previsto dal quinto periodo,» — says that, after that deadline, the regions may dispense with writing the structural restriction into the plans by adopting instead compensatory measures capable of achieving reductions in pollutant emissions consistent with the constraints deriving from European Union law.
The architecture is asymmetric, and that is what matters to a fleet: after the deadline the restriction is avoided only by compensating elsewhere, while before it can be introduced at will. Moving the deadline extends by twelve months the window in which the decision is entirely regional.
It is the second postponement of the same sentence
Not the first time: until 19 July 2025 the fourth sentence read «A decorrere dal 1° ottobre 2025». Decree-law 73 of 21 May 2025, converted with amendments by law 105 of 18 July 2025, moved it to 2026 through article 5, paragraph 3-ter, and in the same move replaced «30.000» with «100.000» in the population threshold of the third sentence and added the fifth and sixth sentences. Two moves in sixteen months, and a perimeter narrowed in between.
The text you read today is not the one in force
Checked this morning in two clean sessions on Normattiva: article 1 of decree-law 121/2023 is shown as «Testo in vigore dal: 20-7-2025», the fourth sentence still reads «dal 1° ottobre 2026», and the article’s amendment history stops at law 105/2025. The decree is in force, and the consolidated text does not show it. It is the defect we documented on European texts: the right source, in the wrong version. Anyone opening that page today reads the old date.
What holds anyway
Paragraph 1 says what the scheme is for: to secure the enforcement of the Court of Justice judgments of 10 November 2020 in case C-644/18 and of 12 May 2022 in case C-573/19. It covers Piedmont, Lombardy, Veneto and Emilia-Romagna, and applies as a priority in the urban areas of municipalities with more than 100,000 inhabitants served by an adequate local public transport service, falling within zones where one or more of the limit values for particulate matter PM10 or nitrogen dioxide NO2 is exceeded.
The ways out are written down, and they are regional. The second sentence requires the regional measure to state and give reasons for its derogations — «si indicano e si motivano le relative deroghe» — and to leave out vehicles in the categories expressly exempted from traffic bans under article 6, paragraph 1 of the highway code. Paragraph 2-bis allows exemption of vehicles from Euro 3 onwards running «monofuel o bifuel» on the alternative fuels listed in legislative decree 257 of 16 December 2016. Paragraph 2-ter provides for a decree of the transport minister, in agreement with the environment minister, within sixty days, on easier access for vehicles of historical and collectors’ interest.
There is one more date to hold. A decree-law loses effect from the outset if it is not converted within sixty days of publication (article 77, third paragraph, of the Constitution): published on 28 September, the sixtieth day falls on 27 November 2026. Conversion can change the text, and 2027 is not settled yet.
Why this takes a system, not a spreadsheet
The data that defends you is not the rule, it is your fleet: for every plate, the emission class and the fuel as the vehicle register has them — not as the office remembers them —, the municipality the vehicle enters every day, the date you can leave the contract without penalty. Three facts in three systems that do not talk to each other. While they stay apart, the question “how many vehicles stop if a region moves early in January?” takes two weeks to answer.
Complying. The system keeps the fleet register by emission class, fuel and municipality of use, watches the air quality plans and implementing measures of the four regions as they come out, and opens a check only on the vehicles a given measure touches — with the dated record of which text was in force on the day of the decision, ready to show an inspector or a client demanding continuity of service.
Deciding. The same base holds fleet, delivery rounds, contracts, on-board telematics and deadlines in a single operating model, on which AI agents simulate a region moving early and propose the reassignment of vehicles, with your fleet manager in command — for large enterprises, logistics, manufacturing, defence, public administration and healthcare. On-premise on standalone machines that need no deep integration into your network, or a dedicated cloud in Italy, always jointly managed.

What we do not know
We do not know whether or when one of the four regions will use the power in the first and sixth sentences: we have not verified it against regional acts and we do not assert it. We do not know how many vehicles are affected: no public source cross-references emission class, N category and municipality of use. We found no adoption of the decree under paragraph 2-ter. And the consolidated text may be aligned at any moment after our check.
